DPA 2025 Annual Conference

The presentation will include discussion of the state and federal law about Brady violations and what must be proven by defense counsel at both levels. The presentation will also cover the ethical obligations of prosecutors in terms of disclosure of Brady material and prosecutors obligations as to evidence held by others, such as law enforcement, and any ethical obligations defense counsel has to obtain Brady material they believe to be in existence and not provided. Lastly, the presentation will cover consequences which can be requested for defense counsel if a Brady violation has occurred.
